End User Licence Agreement

This End User Licence Agreement ("Agreement") is a legal agreement between you ("User", "you", or "your") and Topjoyfully ("Company", "we", "us", or "our"), the operator of topjoyfully.com ("Service"). By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by this Agreement. If you do not agree, you must not access or use the Service.
1. Definitions
The following definitions apply throughout this Agreement:
- Service refers to the website, platform, content, tools, and any related offerings operated by Topjoyfully at topjoyfully.com.

3. User Accounts
3.1 Registration
Certain features of the Service may require you to create a User Account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.
3.2 Account Security
You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at support@topjoyfully.com if you suspect any unauthorised use of your account.
3.3 Account Termination
We reserve the right to suspend or terminate your account at our sole discretion, without notice, if we believe you have violated this Agreement or any applicable policies.
4. Intellectual Property
4.1 Ownership
All Intellectual Property rights in the Service and its Content are owned by or licenced to Topjoyfully. Nothing in this Agreement transfers any ownership rights to you. Your use of the Service does not grant you any rights in or to the Content beyond the limited licence expressly set out in this Agreement.
4.2 Feedback
If you submit suggestions, feedback, or ideas regarding the Service ("Feedback"), you grant us a perpetual, irrevocable, worldwide, royalty-free licence to use, reproduce, modify, and incorporate that Feedback into the Service without any obligation to you.
5. User-Generated Content
5.1 Your Content
If the Service permits you to submit, post, or share content ("User Content"), you retain ownership of that content. By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free licence to use, host, store, reproduce, modify, and display your User Content solely for the purpose of operating and improving the Service.
5.2 Prohibited Content
You must not submit User Content that:
- Infringes any third party's intellectual property or other rights.
- Is unlawful, defamatory, obscene, harassing, threatening, or otherwise objectionable.
- Contains malware, viruses, or other harmful code.
- Constitutes unsolicited commercial communications.
- Impersonates any person or entity.
5.3 Removal of Content
We reserve the right to remove any User Content at our sole discretion and without notice if we determine it violates this Agreement or is otherwise harmful to the Service or its users.
6. Third-Party Services and Links
The Service may contain links to or integrations with third-party websites, services, or resources. These are provided for convenience only. We do not endorse, control, or assume responsibility for any third-party services or their content. Your use of any third-party service is subject to that service's own terms and conditions.
7. Disclaimers
7.1 Educational Content
All Content provided through the Service is for general educational and informational purposes only. We make no representations or warranties that the Content is accurate, complete, current, or suitable for any particular purpose.
7.2 No Warranty
The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
8. Limitation of Liability
To the fullest extent permitted by applicable law, Topjoyfully and its officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or loss of goodwill, arising out of or in connection with your use of or inability to use the Service, even if we have been advised of the possibility of such damages.
Our total aggregate liability to you for any claims arising under or in connection with this Agreement shall not exceed the greater of (a) the total amount paid by you to us in the twelve months preceding the claim, or (b) one hundred dollars (100.00).
9. Indemnification
You agree to indemnify, defend, and hold harmless Topjoyfully and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:
- Your use of the Service.
- Your violation of this Agreement.
- Your User Content.
- Your violation of any rights of a third party.
10. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into this Agreement by reference. By using the Service, you consent to the collection and use of your information as described in our Privacy Policy.
11. Modifications to the Agreement
We reserve the right to modify this Agreement at any time. When we make changes, we will update the "Last Updated" date at the top of this page. Your continued use of the Service after any changes take effect constitutes your acceptance of the revised Agreement. We encourage you to review this Agreement periodically.
12. Termination
12.1 By You
You may stop using the Service at any time. If you have a User Account, you may request deletion of your account by contacting us at support@topjoyfully.com.
12.2 By Us
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, all licences granted to you under this Agreement will immediately cease.
12.3 Survival
The following sections shall survive termination of this Agreement: Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and any other provisions that by their nature should survive.
13. Governing Terms
This Agreement constitutes the entire agreement between you and Topjoyfully with respect to the Service and supersedes all prior or contemporaneous agreements, representations, or understandings. If any provision of this Agreement is found to be unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of this Agreement shall not be deemed a waiver of that right or provision.
